These Terms of Service (“Terms”) govern your access to and use of the Taptale platform, including the web application at taptale.app, the Taptale Chrome browser extension, and related services (collectively, the “Service”), operated by TERMINAL92 LLC (“Company,” “we,” “us,” or “our”).
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
1. Definitions
- “Account” means your registered Taptale user account.
- “Content” means any video, audio, recording, image, text, demo, transcript, or other material you upload, create, or generate using the Service.
- “Viewer” means any person who accesses Content through a share link.
- “Workspace” means a collaborative environment within Taptale where Content is organized and managed.
- “Share Link” means a URL generated by the Service that provides access to specific Content.
- “Extension” means the Taptale Chrome browser extension.
- “Plan” means the subscription tier (Free, Professional, or Business) under which you access the Service.
2. Eligibility
You must be at least 18 years old to use the Service. Taptale is a business-to-business platform designed for professional use. By using the Service, you represent and warrant that you are at least 18 years of age. If you are using the Service on behalf of an organization, you further represent that you are authorized to agree to these Terms on behalf of that organization.
3. Account Registration
3.1 Account Creation
You may create an account using email/password or through a supported OAuth provider (Google, GitHub, Microsoft). You must provide accurate and complete information.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your credentials
- All activity that occurs under your account
- Notifying us immediately at support@taptale.app if you suspect unauthorized access
3.3 One Person, One Account
Each account is for a single individual. Sharing account credentials is prohibited. Multiple users should be added as workspace members with appropriate roles.
4. Workspaces and Collaboration
4.1 Workspace Roles
Workspaces support three roles:
- Admin: Full access including member management, billing, and workspace deletion
- Editor: Can create, upload, edit, and share Content
- Viewer: Read-only access to Content
4.2 Workspace Responsibility
The Admin of a workspace is responsible for:
- Managing member access and permissions
- Ensuring workspace members comply with these Terms
- Content uploaded by workspace members
4.3 Invitations
Workspace Admins may invite others via email. Invitations are valid until accepted or revoked.
5. Acceptable Use
5.1 You May
- Upload and share video recordings and interactive demos
- Record your own screen, browser tabs, and camera for demo creation
- Share Content with others via share links
- Use AI-powered search features within your workspace
5.2 You May NOT
- Record content you do not have the right to record (e.g., copyrighted material without permission, confidential information of others without authorization)
- Upload, share, or create Content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
- Use the Service to distribute malware, phishing content, or deceptive material
- Attempt to gain unauthorized access to the Service, other accounts, or connected systems
- Circumvent usage limits, rate limits, or billing restrictions
- Use automated scripts, bots, or scrapers to access the Service (except via our documented API)
- Reverse-engineer, decompile, or disassemble any part of the Service
- Resell, sublicense, or redistribute access to the Service without written permission
- Use the Service in violation of any applicable law or regulation
- Interfere with or disrupt the Service or its infrastructure
- Impersonate another person or entity
- Use the Extension to record content in violation of the terms of service of the website being recorded
- Submit false, misleading, or fraudulent information
5.3 Recording Consent
When using the Extension or screen recording features, you are responsible for:
- Obtaining any required consent from individuals who may appear in your recordings
- Complying with applicable recording and wiretapping laws in your jurisdiction
- Ensuring you have the right to record the content displayed on your screen
5.4 Enforcement
We may suspend or terminate your access if you violate these Terms. We reserve the right to remove Content that violates these Terms without prior notice.
6. Content Ownership and Licenses
6.1 Your Content
You retain all ownership rights to Content you upload or create using the Service. We do not claim ownership of your Content.
6.2 License to Us
By uploading Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to:
- Store, process, and transmit your Content as necessary to provide the Service
- Generate thumbnails, transcripts, and embeddings from your Content for Service functionality
- Display your Content to Viewers you authorize via share links
- Create backup copies for disaster recovery
This license exists only for the purpose of operating and improving the Service and terminates when you delete your Content or account.
6.3 AI Processing
When you use AI-powered features (Knowledge Search, Smart Intro), portions of your Content (primarily transcripts) are processed by third-party AI providers (OpenAI, Anthropic) solely to generate responses to your queries. This processing is governed by our agreements with these providers, which prohibit using your Content for model training.
Data handling during AI processing:
- Transcript excerpts are sent to AI providers via their APIs in real-time and are not cached by TERMINAL92 beyond the duration of the API request
- AI providers process data in memory and do not retain your Content after the API response is delivered, per their data processing terms
- AI-generated responses (answers, citations, smart intros) are stored in our database for your future reference
Regulated data warning: The Service is not designed to process, store, or transmit data subject to specific regulatory requirements, including but not limited to: protected health information (PHI) under HIPAA, payment card data under PCI-DSS, classified government information, data subject to ITAR or EAR export controls, or data covered by specific financial regulations (SOX, GLBA). You are solely responsible for ensuring that Content you upload or process through AI features does not contain such regulated data. If your organization requires compliance with these frameworks, contact us at legal@taptale.app to discuss enterprise arrangements before using the Service.
6.4 Viewer Content
Viewers may submit limited information when accessing your shared Content (email address, reactions, comments). This data is associated with your workspace and subject to your workspace's data management.
6.5 Feedback
If you provide feedback, suggestions, or ideas about the Service, we may incorporate such feedback into the Service without compensation or attribution.
7. Sharing and Public Content
7.1 Share Links
When you create a share link, Content accessible via that link becomes viewable by anyone who has the link (subject to any password or email gate you configure). You are responsible for managing who receives your share links.
7.2 Embed Code
If you use the embed feature, your Content may be displayed on third-party websites. You are responsible for ensuring this use complies with applicable laws.
7.3 Share Link Security Features
We provide optional security features for share links:
- Password protection: Require a password to view
- Email gating: Require email submission before viewing
- Expiration: Set an automatic expiration date
- View limits: Limit the number of views
These features are tools for your convenience. We do not guarantee they will prevent all unauthorized access.
7.4 Analytics
When Viewers access your shared Content, we collect analytics data (described in our Privacy Policy) and make it available to you through your workspace dashboard.
8. Subscription Plans and Billing
8.1 Plans
The Service is available in multiple tiers:
- Free: Limited features and usage quotas
- Professional: Extended features and higher quotas
- Business: Full features and maximum quotas
8.2 Payment
- Paid plans are billed in advance on a monthly or annual basis
- Payment is processed by Stripe. By subscribing, you also agree to Stripe's terms
- All fees are in US Dollars unless otherwise stated
- Prices are exclusive of applicable taxes, which will be added where required
8.3 Plan Changes
- Upgrades: Take effect immediately with prorated billing
- Downgrades: Take effect at the end of your current billing period
- Cancellation: You may cancel at any time. Access continues until the end of your billing period
8.4 Usage Limits
Each plan includes specific limits (storage, assets, recording minutes, workspace count). If you exceed your plan's limits:
- You will be notified and prompted to upgrade
- New uploads or recordings may be blocked until limits are resolved
- Existing Content will not be deleted due to plan limits
8.5 Refunds
We do not offer refunds for partial billing periods on monthly plans. Annual plan subscribers may request a full refund within 14 days of initial purchase if they have not substantially used the Service during that period. If you believe you were charged in error, contact support@taptale.app within 30 days.
8.6 Free Plan
The Free plan may be modified, limited, or discontinued at any time. We will provide 30 days' notice before materially reducing Free plan features.
9. Chrome Extension
9.1 License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Taptale Chrome Extension in connection with the Service.
9.2 Extension Functionality
The Extension enables you to:
- Record interactive screen demos (DOM and screenshot-based)
- Record video from your screen, camera, and microphone
- Upload recordings to your Taptale workspace
9.3 Extension Permissions
The Extension requests the following browser permissions, each required for its core recording functionality:

| tabCapture | Required to capture video and audio output from the current tab for video recordings. Only used when you start a video recording. |
| desktopCapture | Required to capture your full screen or application window for screen recordings. Only used when you select screen recording mode. |
| storage | Required to persist your authentication token and recording state so that in-progress recordings survive browser restarts. |
| offscreen | Required to process media encoding (video/audio) in a background document, enabling efficient recording without affecting page performance. |
All permissions are used exclusively during active recording sessions that you initiate. No permissions are exercised passively, in the background, or without your explicit action.
9.4 Extension Limitations
The Extension:
- Only collects data during active recording sessions you initiate
- Only communicates with Taptale servers (
*.taptale.app) - Does not run background processes when not actively recording
- Does not collect browsing history, passwords, or data from non-recorded tabs
- Does not execute remotely hosted code
9.5 Extension Updates
The Extension may update automatically through the Chrome Web Store. Continued use after an update constitutes acceptance of any changes.
9.6 Recorded Content Responsibility
You are solely responsible for the content you record. The Extension captures whatever is displayed in your browser tab. Ensure you have the right to record and share that content.
10. Copyright and DMCA
10.1 Respect for Copyright
We respect the intellectual property rights of others and expect our users to do the same. It is our policy to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”) and applicable international copyright laws.
10.2 Designated Agent

10.3 Filing a Takedown Notice
If you believe that Content hosted on the Service infringes your copyright, submit a written notice to our DMCA Agent containing:
- A physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to have been infringed
- Identification of the infringing material and information sufficient to locate it on the Service (e.g., the share link URL)
- Your contact information (name, address, telephone number, email address)
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner
10.4 Takedown Process
Upon receiving a valid DMCA notice, we will:
- Promptly remove or disable access to the allegedly infringing Content
- Notify the user who uploaded the Content of the takedown
- Provide the uploader with a copy of the notice (excluding your personal contact information if you request)
10.5 Counter-Notice
If you believe your Content was removed in error, you may submit a counter-notice to our DMCA Agent containing:
- Your physical or electronic signature
- Identification of the Content that was removed and its location before removal
- A statement, under penalty of perjury, that you have a good faith belief the Content was removed by mistake or misidentification
- Your name, address, and telephone number
- A statement consenting to jurisdiction of the federal court in Spokane, Washington, and that you will accept service of process from the person who filed the original notice
Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the Content.
10.6 Repeat Infringers
We maintain a policy of terminating the accounts of users who are repeat copyright infringers. We will terminate the account of any user who receives three valid DMCA takedown notices within a 12-month period, or who we determine in our sole discretion to be a repeat infringer.
11. Data Export and Portability
11.1 Your Right to Export
You have the right to export your data from the Service at any time. We provide the following export capabilities:
- Content files: Download your original uploaded videos, recordings, and media files directly from the Service
- Transcripts: Export generated transcripts in text format
- Analytics data: Export viewer analytics and engagement data via the dashboard
- Account data: Request a complete copy of your personal data by contacting privacy@taptale.app
11.2 Format
Exported data will be provided in commonly used, machine-readable formats (e.g., MP4 for video, JSON for structured data, CSV for analytics, plain text for transcripts).
11.3 Timing
Self-service exports are available immediately. Requests for full account data exports submitted to privacy@taptale.app will be fulfilled within 30 days.
11.4 No Vendor Lock-In
We believe your data belongs to you. We will not charge fees for data export, and we will not degrade the quality or completeness of exported data to discourage migration.
12. Intellectual Property
12.1 Our Property
The Service, including its design, code, features, documentation, and branding (excluding your Content), is owned by TERMINAL92 LLC and protected by copyright, trademark, and other intellectual property laws.
12.2 Trademarks
“Taptale” and associated logos are trademarks of TERMINAL92 LLC. You may not use our trademarks without prior written permission, except to identify the Service in the ordinary course of your use.
12.3 Open Source
Certain components of the Service may incorporate open-source software. Such components are subject to their respective open-source licenses.
13. Privacy
Your use of the Service is also governed by our Privacy Policy. The Privacy Policy describes how we collect, use, and protect your personal information.
14. Disclaimers
14.1 As-Is
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
14.2 No Guarantee
We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components. We do not guarantee the accuracy of transcripts, AI-generated answers, or analytics data.
14.3 Third-Party Services
The Service integrates with third-party services (Stripe, Clerk, Cloudflare, etc.). We are not responsible for the availability, accuracy, or practices of these services.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- TERMINAL92 LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL.
- OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
- THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
16. Indemnification
You agree to indemnify, defend, and hold harmless TERMINAL92 LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your Content
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of applicable law
17. Termination
17.1 By You
You may delete your account at any time through account settings or by contacting support@taptale.app. Upon deletion:
- You will have 14 days from the date of account cancellation to export your Content and data before deletion begins
- After the 14-day export window, your Content will be permanently deleted within 30 days
- Active subscriptions will not be refunded for remaining periods
- You will lose access to all workspaces you own
17.2 By Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in activity that poses a security risk or legal liability
- Your account is inactive for more than 12 months (Free plan only)
- Required by law
We will provide reasonable notice before termination, except where immediate action is necessary for security or legal reasons.
17.3 Effect of Termination
Upon termination:
- Your license to use the Service immediately ends
- We will delete your Content within 30 days (unless required by law to retain it)
- Provisions that by their nature should survive termination (including Sections 6.1, 14, 15, 16, and 19) will survive
18. Modifications to the Service and Terms
18.1 Service Changes
We may modify, update, or discontinue features of the Service at any time. We will provide reasonable notice for material changes that negatively affect your use.
18.2 Terms Changes
We may update these Terms from time to time. We will notify you of material changes by email and/or in-app notice at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
If you do not agree with the updated Terms, you must stop using the Service before the effective date.
19. Dispute Resolution
19.1 Governing Law
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.
19.2 Informal Resolution
Before filing any formal dispute, you agree to contact us at legal@taptale.app and attempt to resolve the dispute informally for at least 30 days.
19.3 Arbitration
Any disputes not resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will take place in Spokane, Washington, or remotely at your election. Each party will bear its own arbitration costs. This arbitration provision does not apply where prohibited by applicable law.
19.4 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.
19.5 Exceptions
Either party may seek injunctive or equitable relief in any court of competent jurisdiction for matters relating to intellectual property rights or unauthorized access to the Service.
20. General
20.1 Entire Agreement
These Terms, together with the Privacy Policy and any applicable Data Processing Agreement, constitute the entire agreement between you and TERMINAL92 LLC regarding the Service.
20.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
20.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
20.4 Assignment
You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of substantially all of our assets without your consent.
20.5 Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (natural disasters, war, pandemics, government actions, internet outages, third-party service failures).
